Working with our colleagues in PFK Land Agency we are pleased to have achieved outline planning permission for the erection of a farm workers dwelling near the Solway Coast Area of Outstanding Natural Beauty.

This will enable the continuing family management of the farm and its supporting its ongoing growth.

The application was supported by an appraisal to prove the requirement for additional workers on site.

Extended Permitted Development Rights

Extended ‘Permitted Development Rights’ are due to come into force later this week,  the updated legislation will allow for greater flexibility for the change of use of commercial and town centre uses and also make permanent the permitted development rights for larger home extensions. The Government has decided not to introduce permitted development rights for upward extensions. This suggestion proved to be particularly controversial when the Government consulted on these plans in late 2018.

The legislation creates a new class, JA of the General Permitted Development Order (GPDO), which allows local authorities to consider proposals for the conversion of shops and other high street uses such as takeaways and launderettes to offices under the prior approval process. Class M already allows retail and sui generis uses to be converted to residential without the need for planning permission, but the new regulations would allow takeaways to be converted to housing.

The legislation also makes permanent the provisions for ‘Larger Home Extensions’, which were due to come to an end on the 30 May 2019. These permitted development rights allow for domestic extensions of up to 8 metres (from 4 metres) for a detached house and 6 metres (from 3 metres) for all other houses. There is a prior approval process to follow and neighbour consultation does take place; however, these rights remove the requirement to submit a detailed planning application.

Existing permitted development rights to convert buildings used for storage to residential use, due to end on 10 June 2019, will not be extended.

Approval Granted - Brampton Infant School

Full planning approval has been granted for the conversion of the former Brampton Infant School Lunch Hall to a residential dwelling. The scheme involved the demolition and re-build of the frontage to provide undercroft parking and the provision of a excellently detailed new 3 bedroom house in this non-designated heritage asset.

We are delighted to have been involved in securing the sympathetic reuse of an otherwise redundant building within the Brampton Conservation Area.

The detailed scheme was approved by Carlisle City Council’s Development Control Committee earlier today.

Appeal Allowed for Removal of Local Occupancy Condition in the Yorkshire Dales National Park

We are delighted to receive confirmation that our appeal against a local occupancy condition imposed on a barn conversion in the Yorkshire Dales National Park has been allowed.

The planning condition relates to a historical planning consent granted by Eden District Council in the late 1990’s; however, the property is now located with the extended Yorkshire Dales National Park area.

PFK Planning submitted a planning application to the Yorkshire Dales National Park, which was refused by their Planning Committee. An appeal against this decision was made in July 2018, supported by our grounds of appeal which outlined the justification for the removal of the condition in these circumstances. The condition was not considered to be precise or enforceable.

On the 27th March 2019, we received the appeal decision which confirmed that the Planning Inspectorate upheld our appeal against the retention of the condition. The Inspector agreed that the condition was not sufficiently precise and also found no conflict with Policy RUR3 of the adopted Local Plan.

Outline Planning Approval Granted - Cleator Moor

At the recent meeting of Copeland Borough Council’s Planning Panel, outline planning approval was successfully obtained for a scheme of five executive homes on the edge of Cleator Moor.

Under Copeland Borough Council’s interim housing policy, sites which are located beyond the defined settlement boundary will be considered where they meet a specific set of criteria. The interim housing policy is designed to boost the supply of housing in Copeland and inn particular boost the supply of executive homes across the Borough.

The application site is located off Birks Road, measures approximately 0.4 hectares and is located adjacent to existing housing to the edge of the settlement. An indicative layout scheme was prepared by Gray Associates to demonstrate how the site could be developed to provide five detached dwellings. The application was supported by Copeland Borough Council and recommended for approval. Cleator Moor Town Council raised objections to the scheme and attended the meeting to voice their concerns. After considering the application and the concerns of the Town Council, Members of the Planning Panel voted in favour of the application and approval was granted.

We are delighted to have secured detailed planning approval for two single storey dwellings in Scotby.

The application site was located to the rear of a residential property in part of their garden and adjoining paddock. Detailed planning consent was being sought for two single storey dwellings, this application was a revision of earlier applications on this site.

Wetheral Parish Council submitted objections to the proposed development and as a result the application needed to be heard by Carlisle City Council’s Development Control Committee. The application was recommended for approval and the Development Control Committee voted in favour of granting planning approval for the scheme.

Outline planning permission was sought for the demolition of a domestic garage and the erection of a new dwelling. The site is located in a residential area to the outskirts of Appleby-in- Westmorland, a historic market town. This modest site formed part of the garden of a Grade II listed house.

The application received no objections and Eden District Council granted planning approval under delegated powers.
